Dealer Posting Agreement

This agreement applies to every account approved to post Listings as a Dealer and is in addition to the Terms of Use.

1. Licence. You hold a valid Federal Firearms License and any state licence required for your business, and you will tell us immediately if it expires, is suspended or is revoked. You will provide a copy of your licence on request.
2. Inventory. Every firearm you list is either in your possession or lawful control and entered in your acquisition and disposition record, or available for you to obtain from your distributor and transfer lawfully once a buyer orders it. You will remove a Listing promptly when the item is no longer available.
3. Transfers. You will complete every sale that results from a Listing in compliance with federal, state and local law, including ATF Form 4473 and NICS or state background check where required, in-person delivery at your licensed premises, or shipment only to another Federal Firearms Licensee.
4. Your customers. All dealings with a buyer, including price, payment, deposits, returns, warranties, shipping and any dispute, are between you and the buyer. GunMister is not involved and has no liability for them. You will not tell any buyer that GunMister guarantees, insures or is otherwise part of a sale.
5. Public contact details. The phone number, email, address and website you enter in your storefront settings will be displayed publicly on your Listings. You consent to that display.
6. Inventory connections. If you connect a store platform, product feed or spreadsheet, you are responsible for the content it publishes exactly as if you had typed each Listing, including compliance with the Listing Rules. You confirm you have the right to give us the credentials or store address you supply and license us to use the feed content under section 9 of the Terms. Listings created from a feed go live without individual review; you must check them. We may pause, change or disconnect any connection, and remove the Listings it created, at any time.
7. Automated suggestions. Our software may pre-fill fields from your photographs. You will review and confirm every field before publishing. You, not GunMister, are responsible for the accuracy of every Listing.
8. Marketing tools. If you use the Site's email tools to contact your followers, you are the sender for the purposes of the CAN-SPAM Act, you will honour every unsubscribe, and you will send only to people who have agreed to hear from you.
9. Fees. None at present. We may introduce Dealer fees on at least 30 days' notice.
10. Term. Either party may end this agreement at any time. Your obligations for Listings already posted and sales already made survive.
